プライバシーポリシー（日本語）

本プライバシーポリシーは、「MixSing」（以下「本アプリ」）における利用者情報の取扱いについて定めるものです。 本アプリを利用することで、本ポリシーに同意したものとみなされます。

1. 収集する情報

本アプリは、機能提供のために以下の情報を取得する場合があります。

• 音声データ：利用者が録音・編集・書き出しした音声（端末内で処理・保存されることがあります）。
• 端末内ファイル：利用者が伴奏/音源として本アプリに取り込む音声ファイル（ユーザー操作によりアクセス）。
• アプリ利用情報（任意）：クラッシュログ、診断情報、操作状況など（OS/配信基盤が提供する範囲）。
• 購入情報（該当する場合）：買い切り購入/アプリ内課金に関する取引情報（決済はAppleが処理し、当方は必要な範囲で購入状態を参照します）。

※ 本アプリがマイクへのアクセスを行う場合、iOSの許可（権限）を利用者が承認したときに限り行います。

2. 情報の利用目的

• 録音、再生、ミックス、書き出し、ライブラリ管理など本アプリ機能の提供
• 不具合の調査、品質改善、サポート対応
• 購入状態の確認、課金機能の提供（該当する場合）

3. 情報の共有・第三者提供

当方は、法令に基づく場合を除き、利用者の個人情報を第三者に提供しません。 ただし、以下の第三者サービス（OS/配信基盤/分析基盤等）を利用する場合があります。

• Apple：アプリ配信、決済（StoreKit）、診断情報、クラッシュログ等
• その他：本アプリに組み込まれた分析/クラッシュ解析SDK等（利用している場合）

※ どのSDKを利用しているかは、アプリ内または配信ページの開示内容に従います。

4. データの保存場所と保持期間

• 録音・書き出しデータは、原則として利用者の端末内に保存されます（設定や操作により保存場所が異なる場合があります）。
• 診断情報等は、提供元（例：Apple）の保持方針に従います。
• 当方が個別にサポート対応で受領した情報（メール等）は、対応に必要な期間保持する場合があります。

5. セキュリティ

当方は、取得した情報の漏えい、滅失、毀損の防止その他の安全管理のために合理的な措置を講じます。 ただし、インターネット/端末環境に起因するリスクを完全に排除できることを保証するものではありません。

6. 利用者の選択と権利

• マイク/ファイル等へのアクセス許可は、iOS設定からいつでも変更できます。
• 端末内に保存された録音データは、利用者が削除できます。

7. 子どものプライバシー

本アプリは、児童から故意に個人情報を収集することを目的としていません。 保護者の方で不適切な情報提供が疑われる場合は、上記連絡先までご連絡ください。

8. 本ポリシーの変更

当方は、必要に応じて本ポリシーを変更することがあります。重要な変更がある場合は、アプリ内/配信ページ等で告知します。

Privacy Policy (English)

This Privacy Policy describes how user information is handled in “MixSing” (the “App”). By using the App, you agree to this Policy.

1. Information We Collect

The App may collect or access the following information to provide its features:

• Audio Data: Audio you record/edit/export (typically processed and stored on your device).
• On-device Files: Audio files you import as backing tracks (accessed only via your actions/permissions).
• Usage/Diagnostics (Optional): Crash logs, diagnostics, and basic usage events provided by the OS/distribution platform.
• Purchase Information (If applicable): Transaction status for one-time purchase / in-app purchases (payments are processed by Apple; we may read purchase status as needed).

The App will access the microphone only when you grant permission in iOS.

2. How We Use Information

• To provide recording, playback, mixing, exporting, and library management features
• To troubleshoot issues, improve quality, and respond to support requests
• To verify purchases and enable paid features (if applicable)

3. Sharing / Third Parties

We do not sell your personal information. We do not share personal information with third parties except as required by law or when using platform services such as:

• Apple: App distribution, payments (StoreKit), diagnostics, crash reporting, etc.
• Other Services: Analytics/crash SDKs embedded in the App (if used)

Specific SDK usage, if any, follows disclosures in the App and/or store listing.

4. Storage & Retention

• Recordings/exports are generally stored on your device (storage location may depend on settings and your actions).
• Diagnostics are retained per the provider’s policy (e.g., Apple).
• Information you send to us for support (e.g., email) may be retained as necessary to handle your request.

5. Security

We take reasonable measures to protect information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

6. Your Choices & Rights

• You can change microphone/file permissions anytime in iOS Settings.
• You can delete recordings stored on your device.

7. Children’s Privacy

The App is not intended to knowingly collect personal information from children. If you believe a child has provided information, please contact us.

8. Changes to This Policy

We may update this Policy from time to time. If changes are material, we will provide notice in the App and/or store listing.

利用規約（日本語）

本利用規約（以下「本規約」）は、本アプリの提供条件および当方と利用者との権利義務関係を定めるものです。 利用者は本アプリを利用することで、本規約に同意したものとみなされます。

1. 利用許諾

当方は、利用者に対し、本規約に従って本アプリを利用するための非独占的・譲渡不能・再許諾不能の権利を許諾します。 本アプリの著作権その他の知的財産権は当方または正当な権利者に帰属します。

2. 禁止事項

利用者は、本アプリの利用にあたり、以下の行為をしてはなりません。

• 法令または公序良俗に反する行為
• 第三者の権利（著作権・肖像権・プライバシー等）を侵害する行為
• 不正アクセス、リバースエンジニアリング、改変、解析、複製、再配布等（法令で許容される範囲を除く）
• 本アプリの運営を妨害する行為
• その他当方が不適切と判断する行為

3. 録音・コンテンツに関する権利

• 利用者が本アプリを用いて作成/録音/編集/書き出しした音声・作品（以下「ユーザーコンテンツ」）の権利は、原則として利用者または正当な権利者に帰属します。
• 利用者は、ユーザーコンテンツについて、第三者の権利を侵害しないこと、必要な許諾（原盤権・著作権・利用許諾等）を得ていることを保証します。
• 当方は、ユーザーコンテンツをサーバにアップロードして保管する機能を提供しない限り、ユーザーコンテンツを当方が取得・保管することは通常ありません（端末内処理が中心）。

4. 料金・購入

本アプリが有料（買い切り/アプリ内課金等）で提供される場合、購入・返金等は原則としてAppleの規約および手続に従います。 当方は、Appleが処理する決済の結果について保証するものではありません。

5. 免責事項

• 当方は、本アプリが利用者の特定目的に適合すること、期待する機能・正確性・有用性を有すること等について、明示または黙示を問わず保証しません。
• 録音レイテンシー等は端末性能、OS、接続機器、設定、周辺環境により変動し、一定の数値を常に保証するものではありません。
• 当方は、本アプリの利用により生じた利用者の損害について、当方に故意または重過失がある場合を除き、責任を負いません。

6. 責任の制限

法令で認められる範囲で、当方が利用者に対して負う損害賠償責任は、（有料の場合）直近に利用者が当方に支払った金額を上限とします。 ただし、当方に故意または重過失がある場合はこの限りではありません。

7. サービスの変更・停止

当方は、必要に応じて本アプリの内容を変更し、または提供を停止することがあります。 重要な変更がある場合は、可能な範囲で告知します。

8. 規約の変更

当方は、本規約を変更できるものとします。変更後の規約は、本ページへの掲載またはアプリ内表示等により効力を生じます。

9. 準拠法・管轄

本規約は日本法を準拠法とし、本アプリに関して紛争が生じた場合、当方所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service (English)

These Terms of Service (“Terms”) govern your use of MixSing (the “App”) and set forth the rights and obligations between you and the provider (“we,” “us”). By using the App, you agree to these Terms.

1. License

We grant you a non-exclusive, non-transferable, non-sublicensable license to use the App in accordance with these Terms. The App and all intellectual property rights remain with us or the rightful owners.

2. Prohibited Conduct

• Violating laws or public order and morals
• Infringing others’ rights (copyright, privacy, publicity, etc.)
• Unauthorized access, reverse engineering, modification, analysis, copying, redistribution (except where permitted by law)
• Interfering with the operation of the App
• Any other conduct we deem inappropriate

3. Recordings & Content Rights

• Rights to audio you create/record/edit/export using the App (“User Content”) generally belong to you or the rightful owners.
• You represent and warrant that you have all necessary rights/permissions for your User Content (including copyrights, master rights, licenses).
• Unless the App provides an upload/cloud feature, we typically do not collect or store User Content on our servers; processing is mainly on-device.

4. Fees & Purchases

If the App is paid (one-time purchase / in-app purchases), payments, refunds, and related processes are handled under Apple’s terms and procedures. We do not guarantee outcomes of Apple’s payment processing.

5. Disclaimers

• The App is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose.
• Latency and performance depend on device, OS, connected equipment, settings, and environment; specific numeric values are not guaranteed at all times.
• We are not liable for damages arising from your use of the App, except where caused by our willful misconduct or gross negligence.

6. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid to us for the App (if any) in the most recent period. This limitation does not apply where prohibited by law or in cases of willful misconduct or gross negligence.

7. Changes / Suspension

We may modify, suspend, or discontinue the App at any time as reasonably necessary. Where practicable, we will provide notice of material changes.

8. Changes to These Terms

We may update these Terms. Updated Terms become effective upon posting on this page and/or presenting them in the App.

9. Governing Law / Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising out of or relating to the App will be submitted to the court having jurisdiction over our principal place of business as the court of first instance, unless otherwise required by law.
